Mission Fuel Terms of Use

These Terms of Use ("Terms") govern your use of the Mission Fuel mobile application (the "App"), provided by Stormwind Solutions LLC ("Stormwind Solutions," "we," "us," or "our"). By downloading, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Aviation Planning Aid Only
Mission Fuel is a supplemental calculation and planning aid. It is not an approved aircraft system, electronic flight bag program, navigation source, flight-management system, dispatch service, weather source, or substitute for professional judgment.
The App is not affiliated with or endorsed by the Federal Aviation Administration, Department of Defense, United States Army, any military service, aircraft manufacturer, operator, or training organization.
2. Pilot in Command Responsibility
You are solely responsible for flight planning, fuel planning, navigation, aircraft operation, regulatory compliance, and all operational decisions. Always verify App outputs against the current approved aircraft flight manual, rotorcraft flight manual, operating handbook, performance data, weight-and-balance information, instrument procedure, notices, regulations, organizational publications, standard operating procedures, and other governing sources.
Do not rely on Mission Fuel as the sole basis for a safety-critical decision. Confirm calculations independently and maintain legally required and operationally appropriate fuel reserves. If an App result conflicts with an approved or official source, the approved or official source controls.
3. Accuracy and Availability
We strive to provide useful calculations, but inputs may be incorrect, conditions may change, and software or devices may malfunction. We do not warrant that calculations, timers, notifications, conversions, projections, or other results will be error-free, complete, continuously available, or suitable for a particular aircraft, mission, procedure, or operation.
Notifications and timers may be delayed or suppressed by device settings, operating-system behavior, battery-management features, or other circumstances. Maintain independent timing and monitoring appropriate to the operation.
4. License and Acceptable Use
Subject to these Terms and applicable app-store rules, Stormwind Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or internal professional purposes on devices you own or control.
You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, circumvent access controls, interfere with the App, use it unlawfully, or misrepresent an affiliation with Stormwind Solutions, except where applicable law expressly permits otherwise.
5. Mission Fuel Pro and Purchases
Mission Fuel Pro is an optional one-time purchase that unlocks designated features for the purchasing app-store account, subject to Apple App Store or Google Play terms. Prices and taxes may vary by country. Purchases, refunds, billing, family sharing, and restoration are administered by the applicable app store. We do not guarantee that purchase restoration will work across different store platforms or accounts.
Features offered as free or Pro may change in future versions, but a completed lifetime-Pro purchase will continue to be recognized as required by applicable law and app-store rules. Users expressly identified by the App as eligible for legacy access may retain that access subject to the App's legacy-access rules.
6. Intellectual Property
The App, branding, interface, original content, and software are owned by Stormwind Solutions or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
7. Third-Party Terms
Your use of the App may also be subject to the terms of Apple, Google, your device manufacturer, telecommunications provider, and other applicable third parties. Apple and Google are not responsible for the App's operation, support, or content except as required by their terms or applicable law.
8. Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, or uninterrupted availability. Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
9. Limitation of Liability
To the fullest extent permitted by law, Stormwind Solutions and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of life, injury, property, data, profits, revenue, or opportunity arising from or relating to the App or reliance on its outputs.
Where liability cannot lawfully be excluded, our aggregate liability will be limited to the greater of the amount you paid for the App or Mission Fuel Pro during the twelve months preceding the claim or USD $25. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
10. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Stormwind Solutions and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, and expenses arising from your misuse of the App, violation of these Terms, or violation of another person's rights.
11. Changes, Suspension, and Termination
We may update, modify, suspend, or discontinue all or part of the App, subject to applicable law and app-store requirements. We may terminate your license if you materially violate these Terms. Provisions that by their nature should survive termination will survive.
12. Governing Law
These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict-of-law rules, except where the consumer-protection laws of your jurisdiction require otherwise. Any dispute that is not required to be heard elsewhere by applicable law will be brought in a court of competent jurisdiction located in Alabama.
13. Changes to These Terms
We may revise these Terms from time to time. The revised Terms will be posted with a new "Last updated" date. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.
